Website Terms of Use
Purpose
- These Terms of Use are intended to govern your (hereinafter, the “User”) use of the website https://ticketline.pt/ (the “Website”), owned and operated by TICKET LINE, S.A., with headquarters at Edifício Arcis, Rua Ivone Silva, No. 6, 8th Floor Left, 1050-124 Lisbon, registered with the Lisbon Commercial Registry under the single registration and legal entity identification number 504691031 (“Ticketline”).
Acceptance
- Acceptance of the Terms of Use is mandatory for any User who accesses, browses, or uses the Website. If you do not agree to these Terms of Use, please refrain from browsing or using the Website.
Access to the Website
- Access to the Website is prohibited to minors under the age of 16. By accessing the Website, you confirm that you meet this requirement.
- Access to and browsing on the Website are free of charge and open to the public, and does not require registration or the creation of a user account.
- The terms used in these Terms of Use shall be understood in accordance with their definitions set forth in Clause 1 of the Terms and Conditions of Sale.
User Obligations
- By accessing and browsing the Website, the User agrees to:
- Not use the Website for any purposes other than those for which the Website is intended, including illegal purposes or those contrary to good faith and public order.
- Not to use the Website in any manner that may cause damage, interruptions, inefficiencies, or malfunctions to its the functionality or to the computers of third parties.
- Not to use the Website to send or make available information or content belonging to third parties which the User does not have the right to use, such as content protected by any intellectual property or industrial property rights of third parties, or content that includes personal data of third parties.
- Not to impersonate any person or entity, including, but not limited to, a Ticketline representative.
- Not to use the Website to transmit, install, or publish any viruses, malicious code, or other harmful programs or files.
- Not to use the Website to collect personal data from other Users.
- Not to access any section of the Website, other connected systems or networks, or the services offered through the Website by means of hacking, spoofing, password cracking, or any other illegitimate or unlawful means.
- Not to violate or attempt to circumvent the security or authentication measures of the Website or any connected network, or the security and protection measures inherent in the content offered on the Website.
- Not to take any action that causes disproportionate, unjustified, and unnecessary overload on the Website’s infrastructure or network systems, as well as on network systems connected to the Website; or prevent the normal functioning of any of the Website’s features, whether by altering or attempting to alter, illegally or otherwise, access and/or using fraudulent participation methods, through any procedure, and/or through any practice that in any way violates these Terms of Use.
- Not to permit transactions that are illegal or that are deemed by credit card issuers or the acquiring bank as being capable of, or having the potential to, harm goodwill or negatively affect it.
- Not to use any automated system or software, including bots, scripts, or other automated tools, for the purpose of accessing the Website and/or purchasing tickets.
- Any abnormal order or order placed in bad faith, any fraud or attempted fraud, or any incident related to payment of the price may result in the rejection of the order and the blocking of purchasing privileges in the Website’s Online Store.
- The Website must always be used in a responsible, prudent, and careful manner, without disrupting or compromising the continuity, integrity, and quality of its resources and features. The User acknowledges that their use of the Website is at their own risk, and they are solely responsible for any damage caused to their computer system and/or equipment or for other damages or losses, including loss or damage to data, resulting from the use of materials, content, or information obtained in any way through the Website.
- Ticketline reserves the right to suspend, modify, restrict, or interrupt, temporarily or permanently, access to, navigation of, use of, hosting of, and/or transfer of content and/or use of the Website’s services, regardless of prior notice, with respect to Users who violate any of the provisions of the Terms of Use, without the User being entitled to claim compensation for on that basis.
- Users who fail to comply with the Terms of Use will be held liable in accordance with general provisions.
Intellectual Property
- The User accepts and acknowledges that the Website, its structure and layout, the selection, organization, and presentation of its content—including features and the software used therein—are owned by Ticketline, or have been lawfully used or duly licensed in tis favour.
- The Website, as a whole and as a multimedia artistic work, is protected by copyright under applicable law.
- The User acknowledges and agrees that all trade marks, trade names, or logos, as well as any other intellectual property rights in the Website or the Products made available on it, are the property of Ticketline, its licensors, or the Promoters whose Products are sold in the Online Store.
- Ticketline is responsible for managing the design of all information and content on the Website and may, at any time, update it by removing or modifying any content, services, options, and features.
- Ticketline grants the User a free, worldwide, non-exclusive, revocable license, valid for the duration of browsing, to reproduce the subject matter of the rights mentioned in the preceding paragraph for the purpose of viewing the interface and interacting with the Website.
- Under no circumstances does the reproduction permission referred to in the preceding paragraph imply a waiver or total or partial transfer of these rights, except where expressly indicated. Any other use or exploitation of any rights shall be subject to prior and express authorization granted specifically for that purpose by Ticketline or by the brands that own the Products being sold.
- The User must refrain from removing, ignoring, or tampering with copyright notices, as well as technical protection measures or any information or protection mechanisms that the Website may contain.
Liability
- The parties agree to comply with their legal and contractual obligations arising under the Terms of Use.
- If one of the parties fails to fulfill any of its obligations or prevents the other party from fulfilling its obligations, in accordance with the Terms of Use, it shall be liable under the general terms, subject to the limitation set forth in Clause 7.
Limitation of Liability
- Without prejudice to applicable law, the User acknowledges and agrees that Ticketline does not guarantee, nor is it liable for, including but not limited to, the following:
- The continuity of the Website’s content;
- The absence of viruses and/or other harmful components on the Website or on the server hosting it;
- The invulnerability of the Website and/or the impossibility of breaching the security measures adopted;
- The improper transmission and/or reception of any data and/or information on the internet;
- Failure of any receiving equipment or communication lines;
- Any malfunction in the Internet network that prevents the Website from functioning properly;
- The lack of usefulness or performance of the Website;
- Damages caused to you or third parties by any person who violates the terms, rules, and instructions established by Ticketline on the Website or through the breach of its systems;
- Any damage caused to the User’s software or computer equipment while using the Website that results from failures or disconnections in telecommunications networks, leading to suspension, cancellation, or interruption of the provision of the service;
- Any damage to the performance of the Website’s services resulting from false or incomplete information provided by the User;
- Any damages caused by the deletion, corruption, or storage error of any content or other communication data maintained or transmitted by, or through, the use of the services;
- Any damages caused by the User’s direct or indirect violation of the Terms of Use.
- To ensure the security of the Website, Ticketline may, without prior notice, take the necessary steps to ensure the integrity, security, continuity, or quality of the Website, including limitations or restrictions on access. It is the responsibility of each User to take measures to protect their terminal equipment and to implement security measures to prevent unauthorized access.
- No recommendation, information, or result, whether oral or written, provided by Ticketline shall be construed as constituting a warranty of any kind, unless expressly provided for in the Terms of Use.
- In any event, Ticketline’s liability for any damages (whether arising from contractual or non-contractual liability) related to access to, browsing, and other use of the Website is limited to cases in which it acts with intent or gross negligence, in accordance with the law.
- Ticketline shall not be held liable for any loss of profits, emotional distress, or reputational damage, nor for events not attributable to it, particularly cases of unforeseeable circumstances or force majeure. Force majeure includes any other events that are beyond Ticketline’s control and for which it is not legally liable.
Links to Third-Party Websites
- Ticketline may include on the Website links to websites or platforms owned or managed by third parties. When using such third-party websites, the User must review and accept the rules of that website before using it, and acknowledge that Ticketline does not control the content of that website and cannot assume any liability related thereto.
Personal Data
- We process the User’s personal data in accordance with applicable data protection provisions, in particular Regulation (EU) No. 679/2016 of April 27 (“GDPR”) and Law No. 58/2019 of August 8 (the Portuguese Personal Data Protection Law). For more information, please see our Privacy Policy .
Accessibility
- The Website implements accessibility requirements in accordance with Decree-Law No. 82/2022, of December 6, in order to allow it to be used by all persons, including people with disabilities.
- In particular, the Website implements the following features:
- An alternative access mode, in audio format, including read-aloud, voice commands, and colour and font adjustment features, or in tactile format.
- In the read-aloud feature, the voice output conveys only the strictly necessary information and can be stopped, paused, resumed, and repeated (including the most recent segment); and is automatically interrupted upon a new User action or new voice output, except for messages that, for security reasons, must be heard in their entirety. At the time of transaction completion/verification, the voice output includes, specifically, the event identification, date/time, number of tickets, cost, payment method/status, and order reference, without prejudice to accessible digital receipts compatible with screen readers.
- The presentation of text and text images complies with the minimum contrast ratio requirement of 4.5:1, except in the following cases:
- Large-scale text, which must have a ratio of at least 3:1;
- Text or text images that are purely decorative, are not visible to anyone, or are part of an image containing other significant visual content;
- Text that is part of a logo or brand name, to which the contrast requirement does not apply.
- Whenever color is used, it will not be used on its own to convey essential information.
- Whenever there is pre-recorded audio information essential to the use of the Website, equivalent visual information is provided.
Expiration and Duration
- These Terms of Use cease to be effective when the User finishes browsing and disconnects from the Website, with the exception of Clauses 4 to 8 and 12.
Final Provisions
- This agreement is entered into in Portuguese. Translations of these Terms of Use into other languages are provided solely for the convenience of the parties. In the event of any discrepancies between the language versions, the Portuguese version shall prevail.
- Ticketline reserves the right to amend these Terms of Use at any time. Such modifications will be posted on the Website. Each time the User uses the Website, the User is encouraged to read the Terms of Use to be aware of any changes made to them. By continuing to access and use the Website after such amendments to the Terms of Use take effect, the User accepts the Terms of Use in their most current version.
- If any provision of these Terms of Use is declared null and void or in any way invalid, ineffective, non-existent, or unenforceable by a competent authority, such nullity, invalidity, ineffectiveness, non-existence, or unenforceability shall not affect the validity of the remaining provisions of the agreement.
- These Terms of Use, as well as all contracts entered into in accordance with them, are governed by Portuguese law.
- For the resolution of any dispute arising from, or in any way related to, the Terms of Use (including disputes arising from tort liability), the parties agree that the courts of Lisbon shall have jurisdiction.
- The User may submit to arbitration pursuant to Article 14 of Law No. 24/96, of July 31, any dispute whose value does not exceed €5,000.00 (five thousand euros), or the jurisdiction of the courts of first instance at that time. The User may access the list of consumer arbitration centers at the following address: https://www.consumidor.gov.pt/ral-mapa-e-lista-de-entidades.
- Any disputes involving an amount exceeding €5,000.00 (five thousand euros), or exceeding the jurisdiction of the courts of first instance at that time, may be submitted to the jurisdiction of the courts. Alternatively, the User may file a complaint with a Consumer Dispute Arbitration Center, in accordance with the provisions of Law No. 24/96 of July 31.
- The User may turn to the alternative consumer dispute resolution entities listed on the Consumer Portal at www.consumidor.pt, where they can access dynamic and up-to-date information regarding the identification of these entities and their contact details.
- Notwithstanding the foregoing, the User may also file a complaint regarding the Website in the Electronic Complaint Book.
